Will of MATHEW GATHEN


I, Mathew Gathen of the town of Berne, County of Albany, New York, being of
sound mind and memory, do make, ordain, publish and declare this to be my
last will and testament that is to say:

First, After all my lawful debts are paid and discharged, I give, devise
and bequeath to my son Mathew Harvey Gathen, my farm of one hundred and
eighty acres (180) of land, more or less situate in town of Berne, Albany
county, NY with all it's hereditaments and appurtenances now occupied by
said Mathew Harvey Gathen and twenty acres (20) adjoining formerly occupied
by Chauncey Fancher to the said Mathew Harvey Gathen during the time of his
natural life and at his decease to his heirs at said forever.

Second, I give and bequeath to my daughter, Ellen Sholtis two hundred
dollars ($200) and the use of my farm of one hundred and twenty five (125)
acres in Middleburgh, Schoharie County, NY, until my grandson Peter Gathen
shall arrive at the age of twenty one years. The above is for his services
in caring for me.

Third, I give, devise, and bequeath to my grandson, Peter Gathen, the above
said farm of one hundred twenty five acres (125) in Middleburgh, Schoharie
county, NY after he shall arrive at the age of twenty one (21) years to
have and to hold the same during the term of his natural life and at his
decease to his heirs forever.

Fourth, I give and devise to Mathew Gathen, son of David Gathen, two acres
of land in the village of Rensselaerville, Albany county, NY, his heirs and
assign forever and four shares of stock in a blank wad in Albany county,
NY.

Fifth, I give and bequeath to St. Mary's Catholic Church of the city of
Albany, NY, One hundred dollars ($100) and to the Episcopal church in
Rensselaerville, Albany county, NY, One hundred dollars ($100).

Sixth, I give and bequeath 
to Sarah Catherine Hess, Five hundred dollars ($500),
to Elizabeth Kenyon, Two hundred dollars ($200),
to Mary Scott, One hundred dollars ($100), 
to Martha Ball, Two hundred dollars ($200),
to Jane Hess, Two hundred dollars ($200),
to Christina Gathen, wife of Mathew Harvey Gathen, One hundred dollars
($100)


Seventh, I give and bequeath to my grandchildren named below, to be paid
each on his or her arrival at the age of twenty one years as follows to
with:
To Frank Ball, One hundred dollars ($100)
To Frank Hess, One hundred dollars ($100)
To Birdie Wilday, Fifty dollars ($50)
To Mary Wilday, Fifty dollars ($50)
To Morgan Wilday, Fifty dollars ($50)

Eighth, All the rest and residue of my estate of which I shall did seized
in possession after paying the legacies above mentioned. I give and
bequeath to the children of Mathew Harvey Gathen, share and share alike to
be paid to each on his or her arrival at the age of twenty one years.

Ninth, my will is that my selections named below who hold the friends as
trustee's or otherwise until the same is to be paid as specified in
articles sworn in and eight above during the minority of the legalities
named therin shall not be chargable to intrust on said funds while so held
by them.

Tenth, I make constitute and appoint Albert Becker of Middleburgh,
Schoharie county, NY and my son, Mathew Harvey Gathen to be executors of
this my last will and testament hereby revoking all former wills by my
words. In witness when I have hereunto let and solicited by my name and
affixed my seal this twentieth day of June in the year of our lord, one
thousand eight hundred and eighty eight (1888).
