The Last Will & Testament of Robert Furman

Proved and recorded January 13th 1869 as a will of Real and Personal estate

In the name of God, Amen! I Robert Furman in the county of 
Albany and the state of New York, being weak in body but of sound and 
perfect memory, blessed be Almighty God for the same, do make and
publish this my last will and testament in manner and form
following. That is to say:
1st I will that my Executor here after named, pay any [just?] debts and
legacies out of the proceeds of the sale of my personal property, if suf
ficient, but if there should not be at my decease sufficient personal
property to pay my debts and legacies, then so much of my real estate 
shall be sold as will raise sufficient money to pay the same
2nd I give, devise and bequeath to my son Robert the sum of three

hundred dollars to be paid to him on the decease of my beloved wife or 
when my youngest child becomes of age
3rd I give, devise and bequeath to my son Storm the sum of Four hun-
dred dollars to be paid to him on the decease of my beloved wife of when my
youngest child becomes of age.
4th I give, devise and bequeath to my beloved wife Magdalen all the 
rest and residue of my real estate as long as she shall remain unmar-
ried and my widow, but on her decease or marriage, the remainder there
of after payment of legacies, I give and devise to my three sons Andrew,
John Enos and Ellery share and share alike.
In case of the death of either my two sons John Enos or Ellery, before
they attain the age of twenty one years, I will devise and bequeath that there
share of my estate devised to them be equally divided between my sons 
Robert, Storm, Andrew and the surviving minor.
5th I do nominate and appoint my wife Magdalen and my son Robert
to be the Executors of this my last will and testament, hereby revoking
all former wills by me made.
In witness whereof I have hereunto set my hand and seal this 
first day of June A.D. 1868

as witnesses thereto.

Of Albany and Cornelius H. Lansing of Watervliet in the county of Albany
Being first duly sworn in open court, do depose and say, and each for
Himself deposeth and saith, that he is a subscribing witness to the in
Strument now shown to him, purporting to be the last will and 
Testament of Robert Furman of the town of Watervliet in the county
of Albany. That the said Robert Furman did in the presence 
of this deponent subscribe his name at the end of the instrument
which is now shown and exhibited to this deponent as aforesaid,
and which purports to be the last will and testament of the said
Robert Furman, and which bears date on the first day of June
In the year of our Lord one thousand eight hundred and sixty eight.
And this deponent further saith that the said Robert Furman
the said testator did, at the said time of subscribing his name as
aforsaid, at the end of the said will, declare the said instrument
so subscribed, and now exhibited, to be his last will and testament
and this deponent did thereupon subscribe his name at the end
of the said will, as an attesting witness thereto, and at the request
of the said testator. And this deponent further saith that at the 
said time when the said testator subscribed his name to the said

last will as aforesaid, and at the time of the deponent subscribing his name as 
an attesting witness there to as aforesaid, the said Robert Furman was of sound
mind and memory, of full age to execute a will and was not under any restraint
to the knowledge, information or belief of this deponent. And further these de-
ponents not.

I, Israel Lawton surrogate of Albany county, hereby certify that the 
foregoing is a true copy and record of the last will and testament of Robert 
Furman, late of the County of Albany deceased, propounded for probate and 
proved before me and the proof and examinations taken before me in relation 
thereto.
