| In the Name of God, Amen I Garret Flansburgh of the town of Berne in the County of Albany and State of New York, of the age of Eighty two years. And be- ing of Sound disposing mind, and memory, do make, publish, and declare, this to be my last Will & Testament, in manner and form following that is to say, I Commit my Soul into the hands of Almighty God, hoping for a blessed resurrection through merits and mediation of his Son Jesus Christ I do give, devise and bequeath to my Son Garret Flansburgh Junr. all my Real Estate Consisting of the Farm on which I now reside Containing about One Hundred and Forty three and One half Acres of land, Agreeable to a certain Article of agreement made and executed to him, the said Garret Flansbrug, Junr and bearing date August the First, One thousand eight Hundred and Fifty four. Also All my personal property. Except, Money, Notes of Hand, and Bonds and Mort- gages, Subject Nevertheless to the Agreement above mentioned, which is that my Son Garret, is to pay the sum of Twenty Five Hundred dollars, refference being had, to the above mentioned agreement, as follows viz to my Daughter Jane Wife of Matthew Springsteed the sum of three Hun- dred and Seventy five dollars ($375) to my Daughter Catharine Wife of Henry Earl the Sun of Five Hundred and Fifty dollars($550) to my Daughter Hester A. R. Flansburgh the Sum of Six Hundred dollars, the above Legacies to be paid out of the Avails of my Real estate, by my Son Garret Flansburg Junr. to be paid One year After my decease, to them and their Respective Heirs and Assigns forever And to my Grand Daughter, Christian Wife of Frank Warner, the Sum of Four Hundred & Fifty dollars ($450) providing she may have an Heir or Heirs, but in case She dies leaving no Child or Children, then and in such case She is only to have the Interest of the above Sum for and during her Natural life, and after her decease, to be equally divided between all my Children Share and Share alike. My Daugh- ter Jane having received two Hundred dollars makes the amount, twenty One Hundred and Seventy five dollars $2,175 leaving the sum of three Hundred & twenty five dollars, out of which Sum my Funeral expenses are to be paid. I do also will and direct that after my Funeral expenses, Just debts & Legacies are paid and fully satisfied, the Rest residue and remainder of my personal property Shall be equally divided between my six sons viz. Henry, John H., James, Walter, Peter and Garret Junr Share and Share alike, to them and to their respective Heirs and Assigns forever I do give and direct that my Household Furniture be equally divided between my viz Jane, Catharine & Hester R. Share and Share alike I do hereby Nominate and Appoint my my two Sons, Henry Flan- burgh and Garret Flansburgh Junr. Executors of this my last Will & Testament hereby revoking all former Wills by me made In Witness whereof I have hereunto set hand and seal the Sixteenth day of October in the year of our Lord one thousand eight Hundred and Sixty Nine Garret Flansburgh L.S The above instrument consisting of one Sheet was at the date thereof declared to us by the Testator Garret Flansburgh to be his last Will and Testament and he then acknowledged to us that he had subscribed the Same and we at his request Signed our Names as attesting witnesses thereto Robert Taylor Residing at New Scotland Albany County Jacob S. Markle Residing at New Scotland Albany County County of Albany, SS: Robert Taylor of the town of Schodac, Rensselaer Co, formerly of New Scotland in the county of Albany and Jacob S. Markle of New Scotland in the county of Albany being first duly sworn in open court, do de- pose and say, and each for himself deposeth and saith, that he is a sub- scribing witness to the instrument now shown to him, purporting to be the last will and testament of Garret Flansburg of the town of Berne in the county of Albany. That the said Garret Flansburgh did in the presence of this deponent subscribe his name at the end of the instrument which is now shown and exhibited to this deponent as aforesaid, and which purports to be the last will and testament of the said Garret Flansburgh and which bears date on the Sixteenth day of October in the year of our Lord one thou- sand eight hundred and sixty nine. And this deponent further saith that the said Garret Flansburgh the said testator did, at the said time of subscribing his name as aforesaid at the end of the said will, declare the said instrument so subscribed, and now exhibited, to be his last will and testament; and this deponent did thereupon subscribe his name at the end of the said will, as an attesting witness thereto, and at the request of the said testator. And this deponent further saith, that at the said time when the said testator subscribed his name to the said last will as aforesaid, and at the time of the deponent's subscribing his name as an attesting witness thereto as aforesaid, the said Garret Flansburgh was of sound mind and memory, of full age to execute a will, and was not under any restraint, to the knowledge, information or belief of this depo- nent. And further these deponents say not Subscribed and sworn this 14th day Robert Taylor of May 1879, before me. Jacob S. Markle P. A. Rogers Surrogate I, Peter A. Rogers, Surrogate of Albany County, hereby certify the fore- going to be a true copy and record of the Last Will and Testament of Garret Flansburgh late of the town of Berne deceased, propounded for probate and proved before me and the proofs and examinations taken before me in relation thereto.
