Peter Campbell ’s Will

This day the last will & testament of Peter Campbell, late of Franklin Township,

Franklin County Ohio, deceased who died November 25, 1870 was produced in open court, and

offered for Probate. Thereupon George McCracken………up the outstanding witness

Is the said will, appeared, and in open Court on oath.testified to the…..

of said…, which testimony was recorded in writing and subscribed by said witnesses and

it appearing to the court from said testimony that said Peter Campbell at the time of ex-

ecuting said will, was of full age, of sound mind and memory did not under any res-

traint, it is therefore ordered by the Court that said will be read and the same hereby is admitted

to Probate, and that the same with the testimony be recorded in the will records of this office

I Peter Campbell of Franklin County Ohio do make and publish this my last

Will and testament

Item 1st I direct that all my just debts be paid out of my personal Estate as

soon as convenient.

Item Second I give and devise to by beloved wife Mary B Campbell the Home-

stead farm on which we now reside containing about Ninety five acres for her

sole and seperate using during life also with the household and kitchen furni-

ture of every kind and with all my horses carriages livestock farm implements and

every kind of goods chattels and effects except the notes stocks and other property

hereinafter specifically bequeathed, and I hereby confirm to my wife her right

and title to all notes and other property held by me in her name or for her use

whether heretofore or hereafter conveyed to her. And I request my wife in view of

the above provisions with others that I have already made for my wife that I

will convey during her life or devise at her death the real estate inherited from her

father to our adopted son Joseph A. Campbell and her separate personal estate to

our adoped daughter Nancy R. Campbell.

Item Third On the death of my wife I give and devise the said homestead farm

and the personal property remaining above bequeathed to my wife to our adopted daugh-

ter Nancy R. Campbell absolutely in fee simple for her sole and separate property.

Item Fourth I give and devise to Mrs. Ann Toles for her use during her life the

house and lot down on …….Street in the City of Columbus Ohio she is to pay all

assessments and taxes levied thereas and at her death I give and devise the same to

my adopted son Joseph G Campbell.

ble of Columbus Ohio Fifty shares of the Capital stock of Franklin Insurance Company of

Columbus Ohio and fifty shares of the Capital Stock of the Capital City Insurance Company of

Columbus Ohio to have and hold the same in trust for the following uses…to reserve annual income therefrom when the same is made payable in cash and use and pay out the note pro-

ceeds of the same for the support maintenance and education of our adopted son Joseph G

Campbell until he arrive at the age of twenty one years and at that age to transfer said stocks

to him free of all further trust for his sole use. In case the said Capital Stock should be paid

to said Trustees by reason of the said Companies or either of them ceasing to do business said trus-

tee is hereby authorized to invest and reinvest the same in State or United States bond or mortgage

notes as they may deem best and pay over the net income there of as aforesaid and transfer the

principal in like manner and time as above provided to said legatee.

Item Sixth I give and devise to my nephew the Rev. Levi Shells One Thousand Dollars pay-

able in one year of my decease without interest.

Item Seventh I give and devise to my niece Mrs. West wife of the Rev. West of Palatine

Line Bridge State of New York One Thousand Dollars payable one year after my decease with-

out interest.

Item Eighth I give and devise to my grand nephew Peter Campbell West Five Hundred

dollars payable in one year after my decease without interest.

Item Ninth I give and bequeath to my Nephew Peter Henry Campbell son of William Cam-

pbell One Thousand dollars payable in one year after my decrease without interest.

Item Tenth I give and devise to Mrs. Sue V. Jackson Five Hundred Dollars payable in

one year after my decease without interest. I further desire Mrs. Jackson who now resides in

my family to remain so long as she sees proper that she shall have and shall all the

comforts of my family such as Board clothing medical attendance to …with

the rest while she so remains. If she chooses to leave she is at liberty to do so at any

time. Still I wish her to feel that I am disposed to act liberally & therefore give

her the above legacy in addition to her support as above while she remains.

I hereby revoke all former wills and codicils by me made.

Item Eleven I give to my namesake Peter Schill son of Rev L Schill five

hundred dollars payable in one year after my decease without interest.

I hereby appoint my wife sole Executrix of this my last will and testament with

full power to compromise and settle all claims and demands due to and from me and ex-

ecute any conveyance that may be necessary to close up my estate or fulfill any

real contracts unperformed entered into by me with such covenants by doing any…

as may be proper. And I hereby request that no appraisement or sale of my personal

estate shall be made that in no event shall my wife as tenant for life of real or

personal property under this will be held liable to account for her use of the same

to any person whomsoever or required to give any inventory or bond of or for the same

that during her life she shall use the same as her own with full power to sell or

exchange any of the live stock or other property and replace the same at…

and to invest and reinvest said stocks notes & other assets at her own pleasure and

discretion. My intention being to grant her the fullest and freest use of said prop-

erty while she lives and having full confidence in her kind wishes for said adopt-

ed daughter to leave to said daughter the part of said personal property …..

mentioned in Item Second as remains at the death of my wife.

It is my further wish that my wife as Exutrix aforesaid should confer…

our friend Henry C. Noble in regard to the management of her ….

later in those matters involving legal questions and be governed by his…….

I further request that Probate…..

as Executrix or of her or said Henry C. Noble a trustee under this Will. All legacies pay

able in one year are not to be so paid if it cause any distress to my wife but as soon

thereafter as is convenient to her.
